Gerard was excellent with his marketing and negotiating, no questions - five stars for that. Gerard also quoted the most realistic sale price when he was securing the listing, the other two agents suggested a much higher possible price and the market simply was not at that level. The only negative was in that the deposit was a) less than the commission so if the sale had then fallen through there would have been a balance owing to Harcourts; b) paid direct via a Kiwisaver provider, which has a special condition that if the sale falls through it must be returned to the Kiwisaver provider by our lawyer who was holding it in trust. This was not explained to us by Gerard when he told us that the deposit was coming from Kiwisaver - effectively the deposit was (I understand) compulsorily refundable to the prospective purchaser if they did not proceed with the sale. The sale went through on the agreed settlement date no problem, but the deposit details did potentially expose us if it had not done so.
