Thank you for taking the time to share your feedback. At Harcourts, we take our commitment to transparency and professional service very seriously, and I appreciate the opportunity to clarify the details of this transaction.
Our goal throughout this process was to ensure you had access to all available property information. We provided the full 279-page Geotechnical report for the development, which outlined the High Land Instability classification and all other information made available to us was also shared with you. Because of the nature of section sales, Legal and Technical advice was recommended, along with a recommendation to get a PIM report before signing the agreement. Unfortunately, independent professional guidance was not a path you went down and a 3-day solicitor approval in all respects clause was recommended by me and actively included in the agreement to allow you time to seek legal and technical advice after signing.
It is my understanding from our recent conversations, past emails, and from speaking with your building company that your proposed plans and the property title were reviewed before purchase. Furthermore, subsequent consultations with engineers have confirmed that the land is not a "no-build zone," as your proposed dwelling footprint was recently able to be extended by 5 meters, provided the appropriate engineering and piling requirements for the hillside terrain and land instability risk are met.
We know building complexities and unexpected foundation costs can be stressful, but we stand by the comprehensive information, time, and recommendations we provided to help you make an informed purchasing decision.
